Terms of Service

These terms are the agreement between ChiroBooked ("we" or "us") and you. By using our website or our services, you agree to them. If you don't agree, please don't use our website or services.
Who these terms apply to
Clinics on our plan. If your clinic signs up for ChiroBooked, these terms apply to your clinic and to everyone who uses our services for it. Whoever signs up confirms they're allowed to agree to these terms for the clinic. In most of these terms, "you" means the clinic.
Website visitors. If you're just visiting our website, the parts of these terms about using our website apply to you, along with our privacy policy.
Texts we send, and texts clinics send through our software, are also covered by our SMS terms.
Our services
ChiroBooked gives chiropractic clinics in the US one monthly plan. It includes the following.
Your website. A clinic website with online booking, plus heatmaps that show how visitors use it.
Marketing. We set up and run your clinic's ads on Google, Facebook, Instagram and TikTok, in your clinic's own ad accounts, and supply ad creative or use yours. We also handle local SEO, showing up in AI search, and managing your Google Business Profile.
Clinic software. Online booking and scheduling, appointment reminders, missed-call text back, review requests, follow-up campaigns, one inbox for texts, email, Facebook, Instagram and WhatsApp messages, charting with SOAP notes, an AI voice receptionist, and AI replies to texts, DMs and Google reviews.
Tracking and reporting. Tracking phone numbers and UTM tags that show where new patients come from, and a plain-English report every month.
Your account manager. One person at ChiroBooked who knows your clinic and is your go-to for help.
We may change, add or remove features over time. If a change takes away something important in your plan, we'll let you know ahead of time.
Getting started
We aim to have everything set up and running 14 days after our first call. That depends on getting what we need from you on time, such as your logo, photos, clinic details and access to your accounts.
Billing and canceling
Month to month. Your plan runs month to month. There's no contract and no minimum term.
No setup fee. We quote your price on a call before you sign up, and that's what we bill each month. There's no setup fee.
Paying. You agree to pay each monthly charge when it's due. Prices don't include taxes unless we say so. If a payment fails and isn't fixed, we may pause your services until it is.
Price changes. If we ever change your price, we'll tell you ahead of time, and you can cancel before the new price starts.
Cancel anytime. You can cancel whenever you like by emailing sales@chirobooked.com. Canceling stops future charges. Your services keep running until the end of the month you've already paid for, and we don't refund partial months.
Ad spend
Your ad spend isn't part of your plan. We run your ads in your clinic's own ad accounts, and you pay Google, Meta, TikTok and any other ad platform directly for that spend. You approve your budgets, and we run your ads within them. We're not responsible for what the ad platforms charge you.
Your content and patient data
You own your content. Your logo, photos, words and anything else you give us stay yours. You let us use them to provide our services to you, such as putting them on your website and in your ads. You confirm you have the rights to everything you give us.
You own your patient data. Information about your patients belongs to your clinic. We handle it for you, as your service provider, under HIPAA and the agreements we have with you. Our privacy policy explains more.
What stays ours. The software, templates, designs, tools and know-how we use to provide our services belong to us or to the companies we license them from. Using our services doesn't make them yours.
Your responsibilities
Accurate information. Give us accurate, up-to-date information about your clinic, and tell us when something changes. You're responsible for checking that your website, profiles and ads are accurate.
Patient consent for messages. Before you text, call or email patients through our software, get the consent the law requires. Follow the texting and calling laws, including the Telephone Consumer Protection Act, and the carriers' rules. Stop messaging anyone who asks you to stop. Don't make agreeing to marketing texts a condition of care or of buying anything.
Health ad rules. You're responsible for making sure your ads, website and messages follow the rules for health care advertising. That includes the FTC's rules on truthful advertising, your state chiropractic board's rules, HIPAA and the ad platforms' own health policies. Don't make claims you can't back up, and get the permission the law requires before using a patient's name, photo, review or story.
Your own privacy duties. You're responsible for your clinic's HIPAA duties and your own privacy notice, including making sure it covers the tools you use with us, such as website tracking, call tracking and texting.
Your care decisions. Clinical decisions are yours. Charting tools, AI features and reports help you work, but they don't replace your professional judgment. Check the work of AI replies and the AI voice receptionist, and tell patients they're talking with AI or being recorded wherever the law requires it.
Your logins. Keep your logins safe, give access only to people at your clinic who need it, and tell us right away if you think someone got in who shouldn't have. You're responsible for what happens under your accounts.
Results aren't guaranteed
We'll do our best work for your clinic, but we can't promise specific results, such as a number of new patients, bookings, calls, reviews or search rankings. Results depend on things we don't control, including your market, your ad budget, how your team follows up, and how Google, Meta and other platforms work. Results aren't guaranteed.
Using our services the right way
Don't use our website or services to send spam or messages people haven't agreed to get, to break any law, to mislead people, or to post anything harmful, hateful or that you don't have the rights to.
Don't try to get into systems or accounts you're not allowed into, copy our services, sell access to them, or disrupt them for anyone else.
If you do, we may suspend or end your services. We'll usually warn you first, unless the problem is serious or we need to act quickly.
Other companies' platforms
Our services work with platforms run by other companies, such as Google, Meta (Facebook, Instagram and WhatsApp), TikTok, and phone and texting carriers. Parts of our services also run on software from other companies. Your use of those platforms is also covered by their own terms and policies.
We don't control those companies. They can change features, turn down or remove ads, limit reach, suspend accounts or stop working, and we're not responsible when they do. When something like that affects your clinic, we'll help where we can.
Limitation of liability
To the extent the law allows, we provide our website and services "as is" and "as available", and we make no promises about them beyond what these terms say, including any implied promise of merchantability, fitness for a particular purpose or non-infringement. We don't promise our services will always be available or free of errors.
To the extent the law allows, we aren't liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, patients, data or goodwill, even if we knew they were possible. Our total liability for all claims connected to these terms or our services is limited to the amount you paid us in the three months before the claim came up.
Claims from your use. If someone makes a claim against us because of your content, your ads, messages you sent, or your breaking these terms or the law, you'll cover our reasonable costs from that claim, including legal fees.
Some states don't allow some of these limits, so they may not all apply to you.
Ending the service
You can end your service anytime, as explained under "Billing and canceling". We can end it by letting you know ahead of time, or right away if you don't pay, break these terms, or use our services in a way that puts us, your patients or others at risk.
When your service ends, your access to our software and services stops. Before your last day, you can ask us for a copy of your patient data and content, and we'll help you get it. We handle any patient information we still hold as our agreement with you and the law require.
The parts of these terms that should last after the service ends still apply, such as payments owed, ownership and limits on liability.
Changes to these terms
We may update these terms from time to time. When we do, we'll change the date at the top of this page, and we'll let clients know about big changes by email. If you keep using our services after a change takes effect, you're agreeing to the updated terms. If you don't agree, you can cancel.
If you have a problem, please contact us first so we can try to sort it out.
A few more things
These terms, our privacy policy, our SMS terms and anything we agree with you in writing about your plan make up the whole agreement between us. If you've signed a separate agreement with us, such as one about patient information, that agreement wins where the two disagree.
If part of these terms can't be enforced, the rest still applies. If we don't enforce a part right away, we haven't given it up. You can't transfer these terms to someone else without our written okay. We can transfer them if our business changes hands.
